ODA: European Telecoms & Digital Networks Act

In the 25th March 2026 edition of Option Droit & Affaires, Maud Lambert, our partner in IP/IT and data, provides an overview of the key challenges posed by the Digital Networks Act.

The Digital Networks Act marks a transformative shift in the sector, notably through:

✔️ the introduction of a “single passport” aimed at reducing national barriers, whilst maintaining strict competition rules

✔️ a shift towards supporting investment in infrastructure (fibre, cloud, data, AI), moving beyond a purely price-driven approach

✔️ a balanced approach towards major platforms, combining certain measures favourable to operators with the maintenance of stringent requirements (particularly in cybersecurity and network resilience)

 

Given the market’s restructuring and the pursuit of digital sovereignty, this text could permanently redefine the balance of the telecoms sector in Europe.
